The U.S. Supreme Court has just issued a hotly contested decision in the Ricci v. DeStefano case – ruling by a 5-4 margin that city officials in New Haven, Connecticut, violated federal race bias laws when they threw out the results of promotional exams in which minority firefighters scored lower than their white counterparts.
The majority ruled that the city made an illegal race-based decision not to promote the white firefighters, given their higher test scores. But the other justices noted that the fire department feared lawsuits from African-American and Hispanic firefighters who failed to qualify for promotions.
Sounds like a Catch-22, doesn’t it? Well, it is.

She provides employers with labor and employment counsel, including crafting and enforcing discrimination and harassment policies, executive compensation packages, contracts, noncompetition and confidentiality agreements, and other personnel management issues.
